By accessing or using MedShots AI ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

MedShots AI provides an AI-powered professional headshot generation service for healthcare professionals. Users can upload photos and receive AI-generated professional headshots suitable for medical credentials, LinkedIn profiles, and professional use.

3. Account Registration

To use our Service, you must:

Be at least 18 years of age
Provide accurate and complete registration information
Maintain the security of your account credentials
Notify us immediately of any unauthorized use

You are responsible for all activities that occur under your account.

4. Subscriptions, Credit Packs, and Payments

Subscription Plans

We offer subscription plans (Small Practice Plan and Professional Plan) with different features and credit allocations. Details are available on our pricing page.

Credit Packs (One-Time)

We also offer one-time credit pack purchases. Credit pack credits are added to your account balance and do not expire.

Billing

Subscriptions are billed in advance on a monthly or annual basis
Credit packs are billed at the time of purchase
Payment is processed securely through Stripe
Prices are subject to change with reasonable notice

Satisfaction Guarantee & Refunds

We stand behind the quality of our AI-generated headshots. If you are not satisfied with your results, contact our support team and we will work to resolve your concerns, which may include a full or partial refund at our discretion. Refund requests must be made within 14 days of purchase.

Affiliate and Promotional Programs

From time to time, MedShots AI may offer affiliate, referral, partner, or promotional programs. Participation may require approval and may be subject to additional program-specific rules or terms. We may change, pause, or discontinue these programs at any time. We may withhold, adjust, or revoke commissions, credits, or other rewards in cases of fraud, self-referrals, misleading promotion, policy violations, chargebacks, or unpaid or reversed transactions.

Cancellation

You may cancel your subscription at any time. Upon cancellation, you'll retain access until the end of your current billing period. Subscription credits expire at the end of the billing period and do not roll over. Credit pack credits do not expire.

5. Acceptable Use

You agree NOT to:

Upload photos of individuals without their consent
Use the Service to create misleading or fraudulent content
Upload inappropriate, illegal, or offensive content
Attempt to reverse engineer or exploit our AI systems
Use automated systems to access the Service without permission
Violate any applicable laws or regulations
Infringe on the intellectual property rights of others

6. Photo Upload Requirements

When uploading photos, you represent and warrant that:

You have the right to use and upload the photos
The photos are of yourself or you have explicit consent from the subject
The photos do not violate any third-party rights
The photos comply with our content guidelines

7. Intellectual Property

Our Content

The Service, including its original content, features, and functionality, is owned by MedShots AI and is protected by copyright, trademark, and other intellectual property laws.

Your Content

You retain ownership of photos you upload. By uploading, you grant us a limited license to process your photos solely for the purpose of providing the Service.

Generated Content

You own the AI-generated headshots created from your photos and may use them for personal and professional purposes. You may not resell or redistribute the underlying AI technology.

8. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

Merchantability or fitness for a particular purpose
Non-infringement
Accuracy or reliability of results
Uninterrupted or error-free operation

AI-generated images may not always meet your expectations. Results depend on the quality of uploaded photos and the nature of AI technology.

9. Limitation of Liability

To the maximum extent permitted by law, MedShots AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the Service.

Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless MedShots AI, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Upon termination, your right to use the Service will cease immediately. Provisions that by their nature should survive termination shall survive.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

13. Dispute Resolution

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be settled through binding arbitration in accordance with the rules of the American Arbitration Association.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
